Superior Court Lifts TRO Filed by Perth Amboy EMTs—
City to Move Forward with Transfer of EMS Service to RBMC
PERTH AMBOY, NJ – On Friday, August 14, 2009 the Honorable Travis Francis, Assignment Judge of the Superior Court of New Jersey entered an Order denying the Firefighters' Union and several taxpayers' application for a Permanent Injunction restraining the layoff of the City's EMTs and entering into a contract with Raritan Bay Medical Center. The Order also dissolved all prior restraints and vacated the Temporary Restraining Order entered by the Court on July 2, 2009.
In court, the Judge noted that since his July 2, 2009 temporary restraining order (TRO) the New Jersey Civil Service Commission issued a decision on July 9, 2009 denying the EMTs' petition for interim relief against the layoffs. Additionally, the City advertised for proposals pursuant to the New Jersey Local Public Contracts Law, received and evaluated the proposals and submitted a report to the governing body and the public. He found that the Plaintiffs failed to establish a likelihood of success and the merits and, therefore, denied them any further relief.
The next steps including implementation of the layoff plan will be evaluated over the next week or two.
